Privacy Policy

This Privacy Policy explains how Real Estate Plan, LLC (“Real Estate Plan,” “we,” “us” or “our”) collects, uses, discloses and protects personal information when you visit RealEstatePlan.com, contact us by phone, text or email, walk into one of our offices, or use any of our services — real estate brokerage, construction, restoration, marketing, property management, and our title and mortgage relationships.

The short version

  • We collect what you give us on a form or in conversation — your name, how to reach you, and details about your property or your search.
  • We use it to answer you, to do the work you hired us for, and to keep the records New York requires a licensed broker to keep.
  • We do not sell your personal information for money. We never give an advertising network your name, phone number, email address, or the details of your property or your inquiry.
  • We use analytics and advertising technologies that collect online identifiers about your visit. Some state laws call that “sharing.” It is off until you turn it on, you can switch it off again at any time on our Your Privacy Choices page, and we honor Global Privacy Control.
  • You can ask us what we hold, ask us to correct it, ask us to delete it, and tell us to stop marketing to you — by phone, email or mail. See Your privacy rights.

1. Who we are

Real Estate Plan, LLC is a licensed New York real estate brokerage and a group of affiliated service companies serving Long Island and New York City — from Montauk to Manhattan — since 1991. Our office is at 6 S Jersey Avenue, Suite D, East Setauket, NY 11733, and our telephone number is 631-465-0440.

Real Estate Plan, LLC is the party responsible for the personal information described in this policy.

What this policy does not cover. Legal services are provided through the affiliated law office of Christine Thea Rubinstein & Associates, website located at BestNYAttorney.com. That law office is a separate entity, information you give it as a client is protected by the attorney–client privilege and its own policies, and this Privacy Policy does not govern it. This policy also does not cover independent third parties we may refer you to — lenders, title underwriters, inspectors, insurers — each of which has its own privacy practices.

Disclosure: Christine Rubinstein and Alexander Rubinstein are husband and wife. All buyers, sellers, tenants and landlords have the right to choose any real estate broker or attorney they wish — there is no requirement to use our affiliated law office or brokerage.

2. Information we collect

2.1 Information you give us

You give us information when you fill out a form on this site, request a valuation or an all-cash offer, ask about a listing, apply for a position, or simply call or email us. Depending on what you are asking for, that can include:

  • Identifiers and contact details — your name, telephone number, email address, mailing address and the best time to reach you.
  • Property details — the address of the property, its approximate square footage, bedrooms and bathrooms, condition, asking price or budget, occupancy, and whether there are permits, violations, tenants, water damage or an estate involved.
  • What you are trying to do — buying, selling, renting, renovating, relocating, managing a rental, resolving a violation, or planning around an inheritance — and anything else you choose to write in a message box or tell us on the phone.
  • Career information — if you apply to join us as an agent or for a staff position: the position you want, your experience, and whether you hold a New York real estate license.
  • Transaction records — once you become a client, the documents a real estate file requires: listing and buyer agreements, agency disclosures, offers and counteroffers, contracts, inspection and appraisal reports, correspondence and closing documents.

What we do not ask for on this website. Our web forms do not request Social Security numbers, driver’s license or passport numbers, bank or card account numbers, or credit information. Where a transaction genuinely requires that kind of information — a mortgage application, a title file, a wire instruction — it is collected directly by the lender, the title company or the attorney handling the closing, under their own procedures. Never send financial account numbers or wire instructions to us by ordinary email, and always call our office at a number you already have before acting on any wiring instruction you receive.

2.2 Information collected automatically

Like nearly every website, ours records basic technical information when you visit. Our web server keeps standard log entries containing your IP address, the date and time of the request, the pages requested, the referring page, and your browser and operating system type. Our security and anti-spam protections use similar signals. This information is used to serve the site, to diagnose problems, and to detect abuse.

2.3 Information from other sources

  • Multiple listing services and IDX. Listing content displayed on this site comes from the multiple listing service we participate in. Listing data about a property you own is supplied by the listing broker, not by us.
  • Public records. In the ordinary course of preparing a valuation, an offer or a renovation scope, we look at publicly available records — deeds, tax assessments, building department permits and violations, certificates of occupancy, survey and flood maps, and foreclosure filings.
  • Referrals. If someone refers you to us — an attorney, a lender, a past client, a relocation or agent-referral network — they may give us your name and contact information so we can reach out.
  • Vendors and partners. Contractors, inspectors, photographers, title and mortgage partners may share transaction-related information with us so that the file can move forward.

3. How we use information

We use personal information for the following purposes:

  • To respond to you. Return your call, answer your question, send the valuation, prepare the all-cash offer, schedule the walkthrough.
  • To provide our services. List and market a property, represent you as a buyer or tenant, price and perform construction or restoration work, manage a rental, coordinate title and mortgage partners, and carry a transaction through to closing.
  • To market a property you have listed with us — photography, floor plans, virtual tours, print and digital advertising, and syndication to the multiple listing service and consumer portals.
  • To follow up about services you asked about, and to send you market updates or information we think is useful — you can stop this at any time (see section 7).
  • To operate, secure and improve the site — keep it running, block spam and abuse, understand which pages are useful, and fix what is broken.
  • To hire. Evaluate applications for agent and staff positions.
  • To meet legal obligations. New York law requires a licensed broker to keep transaction records; other laws impose fair housing, anti-money-laundering, tax and recordkeeping duties. We also use information to establish, exercise or defend legal claims, and to respond to lawful requests.

Fair housing. Real Estate Plan is an Equal Housing Opportunity brokerage. We do not use, request or consider race, color, religion, national origin, sex, gender identity, sexual orientation, familial status, disability, marital status, military status, source of income, age or any other protected characteristic in deciding how we market a property, whom we serve, or what we show a buyer or tenant.

We do not use your personal information to train artificial-intelligence models, and this site does not offer a chatbot or generative AI feature that receives your personal information. Our analytics and advertising providers process the information described in section 4 under their own terms and privacy policies, which may permit them to use it to operate and improve their own products and services, including machine-learning and artificial-intelligence systems they own. We do not control those uses. Where a provider offers a setting that limits them, we use it.

4. Cookies and similar technologies

Cookies are small files a website stores in your browser. Related technologies include local storage and pixels. We group them as follows:

  • Strictly necessary. Required for the site to work and to remember the cookie choice you made. These cannot be switched off. Our cookie banner records your choice in your browser’s local storage on your own device; that record is not transmitted to us.
  • Functional. Remember preferences so the site behaves the way you left it.
  • Analytics. Help us count visits and understand which pages get used.
  • Marketing. Would be used to measure advertising or to show you our advertising elsewhere.

What this site actually uses today. As of the effective date above, RealEstatePlan.com sets no advertising cookies and contains no third-party ad-network tags, no social media tracking pixels, and no session-recording or heatmap tools. Third-party components embedded in some pages — described in section 14 — may set their own cookies when those pages load.

Nothing in the analytics or marketing categories can load without your permission. Those technologies are not placed in the pages directly. They are registered with a consent gate that runs them only after you have allowed that category, and never while a Global Privacy Control signal is present. Until you choose, both categories are off.

How to control cookies. Use Your Privacy Choices to set your categories, or use your browser settings to block or delete cookies. Your choice is stored per browser and per device, so you will need to set it again on another device, in another browser, or after clearing your browsing data. If a technology has already loaded in the current page before you withdrew permission, it will not load again on the next page you open. Blocking strictly necessary cookies may break parts of the site.

5. How we disclose information

We disclose personal information only as described here:

  • Within Real Estate Plan. Among our brokerage, construction, restoration, marketing and property management operations, so that one team can run the whole file.
  • To service providers acting for us — web hosting, email delivery, spam and bot protection, virtual-tour and photography services, print and digital advertising vendors, document and e-signature platforms, and professional advisors. They may use the information only to perform services for us.
  • To the multiple listing service and listing portals when we market a property you have listed with us. Listing information, including photographs, becomes broadly available and is republished by third parties we do not control, and it generally remains searchable after the sale.
  • To the other side of your transaction and their professionals — the other broker, attorneys, title companies, lenders, appraisers, inspectors, surveyors, municipal building departments and permit expediters — as necessary to complete what you asked us to do.
  • To the affiliated law office at your direction, if you choose to retain it. You are never required to.
  • Where the law requires it — in response to a subpoena, court order, regulator inquiry or other lawful request; to comply with real estate licensing, fair housing, tax and anti-money-laundering obligations; or to protect the rights, property or safety of any person.
  • In a business transaction. If Real Estate Plan is involved in a merger, acquisition, financing or sale of assets, information may transfer as part of that transaction, subject to this policy.
  • With your consent, for anything else.

6. Selling and sharing your personal information

We do not sell your personal information for money. We do not provide your name, telephone number, email address, mailing address, or the details of your property, your search or your inquiry to advertising networks or data brokers, and we never have.

We do share online identifiers for advertising. When you have allowed it, the analytics and advertising technologies described in section 4 collect information about your visit — cookie and device identifiers, the pages you view, and how you arrived — and make it available to the providers of those technologies so we can measure our marketing and show our listings and services to people who have visited us. Under the California Consumer Privacy Act and comparable state laws this activity may be considered “sharing” personal information for cross-context behavioral advertising, and some state laws may treat it as a “sale” even though no money changes hands.

You can turn it off, and it is off until you turn it on. These technologies do not run until you allow them. Use Your Privacy Choices to change your decision at any time, and see section 10 for browser signals we honor. Your choice is recorded for the browser and device you are using.

We do not sell or share the personal information of anyone we know to be under 16.

7. Calls, texts and marketing email

When you give us your telephone number and ask us to contact you, you are asking us to call or text you about your request — including at a mobile number — and you agree that we may do so. Message and data rates may apply. Consenting to marketing messages is never a condition of buying, selling, renting or using any of our services.

To stop: reply STOP to any text, use the unsubscribe link in a marketing email, or call us at 631-465-0440 and ask to be removed. We honor requests promptly. We will still contact you about a transaction that is actually underway — those are service messages, not marketing.

If your number is on the national or New York Do Not Call registry and you would prefer no calls at all, tell us and we will note it in our records.

8. Your privacy rights and how to exercise them

Whatever state you live in, we will do our best to honor the following requests:

  • Know and access — ask what personal information we hold about you, where we got it, why we have it, and whom we disclosed it to.
  • Correct — ask us to fix information that is wrong.
  • Delete — ask us to delete personal information we hold about you.
  • Portability — ask for a copy in a usable format.
  • Opt out of marketing — tell us to stop calls, texts and marketing email.
  • Opt out of sale, sharing, targeted advertising and profiling — we do none of these, so there is nothing to opt out of, but you are welcome to submit the request and we will confirm.
  • Limit the use of sensitive personal information — we do not use sensitive personal information for purposes beyond providing our services.
  • Non-discrimination — we will not deny you service, charge you differently or give you a lesser level of service because you exercised a privacy right.

How to submit a request. Call 631-465-0440, send us a message through our contact form with “Privacy Request” as the reason, or write to Real Estate Plan, Attn: Privacy, 6 S Jersey Avenue, Suite D, East Setauket, NY 11733. You may also use our contact form.

Verification. Before we act on a request to access, correct or delete, we need to be reasonably sure you are who you say you are. We will ask you to confirm details we already have on file — typically the property address and the contact information associated with your inquiry or transaction. We will not ask you for a Social Security number or a financial account number to verify a privacy request. If we cannot verify you, we will tell you and explain why.

Authorized agents. You may use an authorized agent. We will ask for written permission signed by you, and we may still ask you to verify your own identity directly.

Timing. We confirm receipt within 10 business days and respond within 45 days. If we need more time, we will tell you within that period and may take up to 45 additional days.

Limits. We may decline all or part of a request where the law allows or requires it — for example, records a licensed broker must retain, information needed to complete a transaction you asked for, information needed to detect fraud or defend a legal claim, or another person’s information. We will tell you which exception applies.

Appeals. If we deny your request and your state gives you a right to appeal, reply to our response, or write to the address above marked “Privacy Appeal,” within 30 days. We will respond in writing within 45 days with our decision and the reasons for it, and will tell you how to contact your state attorney general if you disagree.

9. State-specific privacy notices

New York

Most of our clients are New Yorkers. New York’s SHIELD Act requires us to maintain reasonable safeguards for private information about New York residents and to notify affected people in the event of a breach; we do both. New York’s real estate license law separately requires us to retain transaction records for at least three years. New York does not currently have a comprehensive consumer privacy statute, but we extend the access, correction and deletion rights described in section 8 to New York residents as a matter of practice.

California

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act, gives you the rights described in section 8. In the twelve months preceding the effective date of this policy we collected the following categories of personal information, for the business purposes described in section 3, from the sources described in section 2, and disclosed them for a business purpose to the recipients described in section 5:

  • Identifiers — name, postal address, email address, telephone number, IP address.
  • Personal information under Cal. Civ. Code §1798.80 — name, address, telephone number, and real property records connected with a transaction.
  • Commercial information — properties considered, offers made, services purchased or inquired about.
  • Internet or other electronic network activity — pages visited on our site, referring pages, browser and device type.
  • Geolocation data — approximate location inferred from an IP address, and the address of a property you ask us about.
  • Professional or employment information — from agent and staff applicants only.
  • Audio and visual information — photographs, floor plans and virtual tours of a property we are marketing; recorded calls where the law permits and where we tell you.
  • Inferences — a general sense of what you are looking for, drawn from what you told us.

We do not collect biometric information. We do not use or disclose sensitive personal information for any purpose other than those permitted without a right to limit. We do not sell or share personal information, and we did not do so in the preceding twelve months. We retain each category for the periods described in section 11.

California’s “Shine the Light” law (Cal. Civ. Code §1798.83) lets California residents ask about disclosures of personal information to third parties for those parties’ own direct marketing. We make no such disclosures.

Right to opt out of sale or sharing. California residents may direct us to stop sharing their personal information for cross-context behavioral advertising. Use Your Privacy Choices, or send a Global Privacy Control signal, which we honor as a valid opt-out request. We will not discriminate against you for exercising this right.

Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia

If you are a resident of a state with a comprehensive consumer privacy law, you have the rights described in section 8 to the extent that law provides them, including the right to confirm whether we process your personal information, to access, correct, delete and obtain a copy of it, and to opt out of targeted advertising, sale and certain profiling. As stated above, we do not engage in targeted advertising, sale, sharing, or profiling that produces legal or similarly significant effects. We do not process sensitive data for these purposes and do not knowingly process the personal data of a minor for targeted advertising or sale. We do not use personal information for decisions made solely by automated means. Submit requests, and appeals of a denial, using the methods in section 8.

Nevada

Nevada residents may direct a covered operator not to sell certain covered information. We do not sell covered information. You may still submit a request to the contacts in section 17.

10. Do Not Track and Global Privacy Control

There is still no common industry standard for responding to a browser “Do Not Track” signal, and this site does not respond to one.

We do honor Global Privacy Control. If your browser or an extension sends a GPC signal, we treat it as an instruction to opt out of the sharing described in section 6. Analytics and advertising technologies will not load, the preference controls on Your Privacy Choices will show as switched off, and that decision cannot be overridden by clicking “Accept All” while the signal is being sent. We treat other recognized opt-out preference signals the same way.

11. How long we keep information

We keep personal information only as long as we need it for the purpose we collected it, and then for as long as the law requires:

  • Transaction and brokerage records — at least three years from the date of the transaction, as New York real estate license law requires, and longer where a tax, contract or statute of limitations period calls for it.
  • Inquiries that never became a transaction — generally up to three years, so we can pick up where we left off if you come back.
  • Construction, restoration and property management records — for the duration of any warranty, lien or limitations period that applies to the work.
  • Job applications — generally up to two years.
  • Web server and security logs — a short rolling window, typically measured in weeks or months.
  • Marketing lists — until you ask us to stop, plus a suppression record so that we can honor your request going forward.

12. How we protect information

We use reasonable administrative, technical and physical safeguards designed to protect personal information: the site is served over encrypted HTTPS connections, form submissions are protected against automated abuse, access to client files is limited to the people who need it, credentials are not stored in the site’s public files, and paper files are kept in secured offices.

No method of transmission or storage is perfectly secure, and we cannot guarantee absolute security. Real estate transactions are a favorite target of wire-fraud criminals. We will never send you wiring instructions by email and then change them by email. If you receive any message that appears to come from us, an attorney, a title company or a lender directing you to wire funds or changing previously given instructions, stop, do not reply, and call our office at 631-465-0440 — a number you look up yourself, not one supplied in that message — before you send anything.

13. Children’s privacy

This site is intended for adults. We do not knowingly collect personal information from children under 16, and we do not sell or share the personal information of anyone under 16. If you believe a child has given us personal information, contact us at 631-465-0440 or the address in section 17 and we will delete it.

14. Third-party links and embedded content

Some pages link to or embed content that is hosted by other companies. When that content loads, the third party receives your IP address and may set its own cookies, governed by its own privacy policy rather than ours. The third parties whose components appear on this site are:

  • Google reCAPTCHA — used on our forms to distinguish real people from automated abuse. Google receives device and usage signals for that purpose.
  • Google Fonts — used to render the site’s typefaces.
  • RICOH360 — hosts the 360-degree property tours embedded or linked on some property pages.
  • Multiple listing service and IDX search — where a page offers live property search, the search is served by our IDX provider on data from the multiple listing service.
  • Our email delivery provider — carries form submissions to our office by encrypted connection.

Links to other sites — including the affiliated law office’s site, listing portals, municipal building departments and lenders — are provided for convenience. We are not responsible for their content or their privacy practices, and we encourage you to read their policies.

15. Visitors outside the United States

Real Estate Plan operates in New York and our services are offered to people in the United States. If you visit this site or contact us from another country, your information will be transferred to, stored and processed in the United States, where privacy laws differ from those in your home country. By contacting us, you understand and accept that transfer.

16. Changes to this policy

We may update this Privacy Policy as our practices, our technology or the law changes. When we do, we will revise the “Last updated” date at the top of this page, and if the changes are material we will give more prominent notice. Continuing to use the site after an update means you accept the revised policy.
