Should you sell before leaving New York?
Sometimes the job, the school year or the closing at the other end decides for you. Where you have a choice, the trade is between certainty and convenience.
- Selling first gives you a known number and a clean purchase, at the cost of possibly needing somewhere to live in between.
- Leaving first gets your life moving, at the cost of carrying an empty house, managing it remotely, and negotiating from a weaker position as the months go on.

What happens if you leave before the house sells?
This is the single most common relocation shape, and the one that goes wrong quietly. The house is empty, you are a plane ride away, and the transaction keeps generating small emergencies that all need somebody physically present.

Before you change your New York residency
Real estate and tax residency are not the same thing. For New York income tax purposes, domicile is the place treated as your permanent home, and New York can also treat you as a statutory resident based on maintaining a permanent place of abode in the state together with the number of days you spend here — currently 184 days or more in the taxable year.
The Department of Taxation and Finance is explicit that domicile does not change simply because you have moved. Its own guidance says a New York domicile continues until you can demonstrate with clear and convincing evidence that you have abandoned it and established a new one, and that it is not enough simply to file a certificate of domicile or register to vote in the new location. People are surprised by that every year.
Selling the New York house is one of the strongest facts in that picture — which is precisely why the real estate side and the tax side should be planned together rather than in sequence.
